Tucsonan sentenced to 19.5 years for being a felon with a firearm

A Tucson man was sentenced Friday to 19.5 years in federal prison after being found guilty on Aug. 30, 2006, for being a felon in possession of a firearm.
U.S. marshals arrested Luis Enrique Garibay at his sister's house on June 7, 2005, under warrants for violating his conditions of release for two prior cases.
A handgun was seen at the foot of a bed during the arrest, and a search revealed the magazine to the gun with 10 rounds of ammunition and a bag of marijuana.
U.S. District Judge Raner Collins sentenced Garibay, 33, to the maximum sentence of 24 months for violating the terms of his supervised release on the two previous cases and additional concurrent sentences for a total of 235 months for being a felon in possession of a firearm.
Collins denied Garibay's request for the mandatory minimum sentence of 15 years after taking into account his criminal record.
Garibay has had six felony adult convictions; his criminal record began at age 16.
He was convicted of robbery Nov. 6, 1995, in Pima County Superior Court and of second-degree residential burglary on Jan. 5, 2006.
Garibay was also convicted on Feb. 4, 2002, in U.S. District Court in Minnesota of conspiracy to distribute and possession with attempt to distribute marijuana.
