A Pima County Superior Court judge this morning declined to increase the bail of a Tucson woman accused of killing a 14-year-old boy in a drunken driving accident, but agreed she should be supervised until her case is resolved.
During a hearing this morning, Deputy Pima County Attorney Mark Diebolt asked Judge Michael Cruikshank to increase Glenda L. Rumsey’s bail from the $50,000 set by another judge following her arrest Jan. 12.
Diebolt said he recently learned Rumsey’s blood alcohol content two hours after the crash that killed Jose Rincon was 0.249. The legal limit in Arizona is 0.08.
Rumsey was able to post her bond, but Diebolt told Cruikshank that if Rumsey remains free he believes she should receive an alcohol evaluation, be monitored by pre-trial services and be tested for alcohol up to four times a week.
The boy’s father, who is also named Jose Rincon, also pleaded with Cruikshank to increase the bail, saying his family feels “battered and betrayed” by the criminal justice system not only because of the low bail, but because a grand jury chose to indict Rumsey on a manslaughter charge instead of a second-degree murder charge.
Cruikshank declined to increase Rumsey’s bail, noting she has no prior criminal history and has strong ties to Tucson, including two children and a job as a paralegal.
The judge ordered pre-trial services to monitor Rumsey. He also told Rumsey she is not to drink, she must submit to toxicology tests and if pre-trial services determines it is appropriate, she must undergo alcohol treatment and take Antabuse, which causes people to become ill if they drink alcohol.
Rincon and a friend were riding their bicycles east on Broadway near Vozack Lane around 7:20 p.m. Jan. 12 when Rumsey, 42, struck both teens with her car - a 2005 Dodge Magnum.
The curb lane turns into a right-turn lane at Vozack Lane, but Rumsey continued east through the intersection, running onto the shoulder of the road and striking Rincon from behind, police said at the time. The impact pushed him into his friend.
Rumsey continued driving but stopped a half-mile later, police said.
Rincon was taken to a hospital, where he was pronounced dead. His friend suffered non-life-threatening injuries.
Rumsey was indicted Jan. 22 on manslaughter, aggravated assault and driving under the influence charges. She was also charged with leaving the scene after causing a fatal crash.
