Seven Tucson charter school operators were fined a combined $67,240 for asbestos-related violations, according to a news release today from the Environmental Protection Agency.
EPA inspectors discovered in May 2006 that the school operators had failed to conduct inspections to determine if material containing asbestos was present in school buildings. They also failed to develop plans to manage any asbestos they found, the news release says.
Asbestos was found and fines were issued at these schools: Pima Partnership School; $12,600; Transformational Learning Center, $12,600; Alternative Computerized Education Charter High School, $12,600; and Tucson Urban League Academy, $11,300.
At City High School, an inspector found asbestos materials, including an area of damaged acoustic ceiling plaster. It was fined $8,800.
The operators of Toltecali Academy, Calli Ollin Academy, and Hiaki High School each were fined $7,300. At Calli Ollin Academy, the inspector found asbestos materials, including about three feet of damaged pipe insulation. A letter from the builder at Toltecali Academy said no material containing asbestos was used.
And no asbestos was found at Hiaki High School, but the required inspection was not conducted before the school opened.
Southside Community School will pay a cash penalty of $1,453, after subtracting the EPA-approved improvements from an initial $2,040 fine. The school operator obtained a written statement from the builder that no asbestos was used in construction, but it did not maintain an asbestos management plan.
School are able to subtract costs related to meeting federal regulations from their initial fines.
All of the schools have taken steps to comply with federal asbestos law. It requires that schools conduct an initial inspection to determine if asbestos-containing building material is present and to develop a plan to deal with it, according to the EPA news release.
Schools also are required to have someone assigned to oversee compliance with the law and to conduct periodic surveillance and re-inspections.
Asbestos in schools has the potential for endangering the health of students, teachers, and others, the EPA said.
