The Federal Energy Regulatory Commission ruled that Tucson Electric Power Co. should recover $10.3 million for fees that were improperly collected by El Paso Electric Co.
TEP was paying El Paso Electric to use a transmission line for energy generated by a power plant about 180 miles east of Tucson.
The FERC ruled last week that under a 1982 agreement, TEP had the right to use the transmission line without restriction and that El Paso Electric must return the amount, with interest, that TEP had paid for using the line.
