Marshals seek Level 3 sex offender in Tucson

Summary: Approximately two weeks after Cruz and his then-wife separated, his stepdaughter told her mother that Cruz had been molesting her for several years, according to court documents.
The girl told her mother that she was afraid to tell anyone because Cruz told her he would hurt her mother if she told anyone, court records show.
The girl who was 10 when she told her mother about the molestation, told police that when she was 5 or 6, Cruz would awaken her, kissing her and touching her inappropriately, court records show.
In 1989, the family moved into the girl's grandfather's home and the molestation stopped, court records show.
It was not until she began having bad dreams that she decided to tell her mother about what had happened, she told police.
The Latest Information: Cruz was arrested in 1990 on charges of molestation of a child and sexual conduct with a minor under age 15.
That same year, he was convicted of molestation and sentenced to 12 years in prison.
In October 2002, Cruz was released from prison, according to the Arizona Department of Corrections Web site.
He had to register as a Level 3 sex offender, which is considered to be the highest level for those who are likely to re-offend.
In February 2006, he moved from his residence in Hayden, and did not update his sex- offender registration as required. Nine months later, a warrant was issued for his arrest for failing to register as a sex offender.
He is believed to be living in Tucson in area homeless shelters.
Cruz is 5 feet, 10 inches tall, weighs 175 pounds and has brown hair and brown eyes.
