A hearing has been set for Sept. 29 in the suit filed earlier this week by the Pascua Yaqui Tribe against the owners of a card room that opened last month on the North Side.

Pima County Superior Court Judge Leslie Miller on Thursday denied the tribe's motion for a temporary restraining order that would have forced Club Royale, 2655 N. Campbell Ave., to shut down immediately.

The hearing will allow lawyers for club owners to argue why a preliminary injunction sought by the tribe should not be granted. The club is owned by Donna and Johnny Ray Rogers and Tombstone resident Harold Lee — a former Maricopa County justice of the peace whose International Card and Game Players Association is also named in the suit.

The tribe's complaint says Club Royale, which opened July 25 and is open daily from 4 p.m. to 4 a.m., is violating state gambling laws and is affecting business in the poker room at Casino del Sol, 5655 W. Valencia Road.
