Ex-border agent guilty in theft of federal money

A former Border Patrol agent who admitted to using an agency credit card for personal use and to selling agency property is facing a year in prison after pleading guilty to a theft charge Monday.
Paul C. Smith III, 33, entered a guilty plea at the Tucson Federal Courthouse to one count of theft of federal money, according to a news release from the U.S. Attorney's Office in Arizona.
The maximum penalty is a year in prison, a $100,000 fine or both. Smith will be sentenced Aug. 14.
During the hearing Monday, he also agreed to pay restitution, resign from the U.S. Border Patrol and not seek future employment with local, state or federal law enforcement, the news release said.
Last December, Smith charged $1,000 worth of work done on a golf cart on a Border Patrol credit card. The golf cart belonged to a friend of Smith's.
Smith said he knew the card was paid automatically out of Border Patrol funds, so there was no way for him to repay the agency.
Smith also admitted to selling at least 35 tires and 10 inner tubes owned by the Border Patrol to a business, K&C Budget Muffler & Performance in Casa Grande, over about a month in 2006.
The equipment cost the agency $4,492.75, the news release said. Smith received $2,750 as a result of his illegal dealings.
