Local tech firm wins patent appeal against Microsoft

Tucson-based Research Corporation Technologies said today it has won a reversal of a federal court decision that denied the local company's charges of patent infringement against computer giant Microsoft Corp.
In what RCT called a "stunning decision" Friday, the U.S. Circuit Court of Appeals reversed a decision of the U.S. District Court for the District of Arizona which had held that six patents held by RCT for digital imaging technology were unenforceable due to inequitable conduct.
The district court had also granted the Microsoft summary judgment of the invalidity of the patents and non-infringement.
RCT, a technology investment and management firm, had sued Microsoft for patent infringement in 2001.
In its ruling today, the Circuit Court of Appeals also vacated the award of attorney fees and removed the trial judge from this case, remanding the case to a new judge, RCT said.
In a prepared statement, Microsoft said its case against RCT's claims "is still in place and remains strong."
"We continue to maintain that these patents are invalid and are not infringed by technology in Windows or Office. We look forward to going to trial for the first time and telling our story in court," the company said in response to a query from the Star.
